Intellectual Property

1. All copyrights, moral rights and other intellectual property rights in the photographs and other contents of the site (“works”) belong to Tamir and are protected by the relevant intellectual property laws worldwide, as well as under international treaties. All rights in these materials are reserved.

2. You are welcome to browse the site and enjoy my works, however please do not copy, transmit, distribute or otherwise use my works other than under a license, which you may purchase as set out below.

 

Licenses

1. I offer two kinds of products: prints and licenses.

2. You can purchase a print reproduction of any of my works, other than those which are for editorial use only. Reproductions are sold framed or mounted as shown on the site. When you purchase a reproduction, it is for your own personal, non-commercial use. For instance, you can use it as a decoration in your home or office, but you cannot make further reproductions of the photograph, such as by posting it on the internet or using it in print.  

3. If you want to use a photograph on a website, or in a publication or video or multimedia presentation, you can purchase a license. The License fee appears on the site and may be amended from time-to-time. The license is royalty-free meaning that you can reuse the photograph in one of the above ways, but it is limited to one year and to print runs of no more than 5,000 and video or multimedia productions whose budget is less than $10,000. If you want to continue to use the photograph past the one year term or in a run of more than 5,000, you may purchase another license.

4. Certain photographs, particularly those depicting people, trademarks or other works, are offered for editorial use only. This means that you can use them in a news report, written article, book or documentary film relevant to the subject of the photograph, but not in other ways.

5. Your license does not cover any use set other than as set out above. In particular, it does not cover use of a photograph on merchandize, such as clothing and accessories,  mugs, souvenirs, school products, toys or video games, in a commercial, or in a video or multimedia production whose budget exceeds $10,000. If you wish to purchase a license for these or other uses such as these, please contact me.

6. Photographs may be cropped, but please do not mutilate them.

7. You must use the following credit on all uses: Photograph © Tamir Wexler.

8. In no case may you use a photograph for the purpose of, or in conjunction with hate speech, or to promote violence, racism or other forms of discrimination, in pornography, or in a manner that defames or denigrates or for shaming or bullying. Neither may you sell photographs as such.

9. Licenses are subject to payment of the license fee as set out on the site.

 

Cancellations

1. Once the photograph has been downloaded you cannot cancel a license. Orders of prints may be cancelled under the conditions set out in the Law for Protection of Consumers.

 

Privacy

1. This site uses cookies, which are small strings of non-identifying information in order to enhance your experience. If you don’t want the site to use cookies, you can disable them through your browser or mobile device.

2. When you purchase a print or license, you will be required to enter certain personal information, such as your name, email and maybe a user name. You grant me permission to use your contact information in order to contact you and to send you promotional materials. You can cancel that permission at any time by sending me an email. I will then delete you from my mailing list, but may still contact you regarding purchases made by you.

3. Payments are processed by third-party payment services. I do not collect or store any information provided by you to them.

 

Complaints

1. If you believe that any photograph or other material infringes your copyright, personal rights or any other right, please contact me, identifying the allegedly infringing marterial. I will be pleased to check your complaint.

 

General

1. These terms form a contract between you and me.

2. These terms may be updated from time-to-time.

3. This site is operated from within Israel. The courts of Tel-Aviv, Israel shall have exclusive jurisdiction over any dispute arising out of or under these Terms of Use, or your use of the
